40§ Hyreslagen
Subletting exists when the landlord opens up his apartment to someone else to use it independently. The landlord is allowed to rent out his apartment, if the "Bostadsrättsförening" / association agrees. If the Bostadsförening / association does not give its consent, the landlord can seek permission at Hyresnämnden. If the landlord is renting out its apartment without consent from the ”Bostadsförening" / association, there is a risk to forfeit the apartment. ”Bostadsföreningen" / the association can never deny the rental when the cause is: test of living together with your partner, study or work abroad, prolonged sickness so that you can´t stay at home, if your work for the military etc.
